Terms of Service

Last updated: September 12, 2026

These Terms of Service ("Terms") govern your access to and use of FreshScanSentry (the "Service"), operated by FreshScanSentry ("we," "us," or "our"). By checking the authorization box before running a scan, purchasing a package, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Authorization to Scan — read this carefully

The Service performs active network and web application scanning (via tools including Nmap and OWASP ZAP) against targets you submit. Scanning a system you do not own or do not have explicit, current permission to test may be illegal in your jurisdiction (for example, under computer-fraud and unauthorized-access laws) and may expose you, and potentially us, to civil or criminal liability.

By submitting any target to the Service, you represent and warrant that:

You agree to indemnify, defend, and hold harmless FreshScanSentry, its operators, and its personnel from any claim, loss, liability, fine, or expense (including reasonable legal fees) arising out of a target you submitted being scanned without proper authorization.

2. The Service

FreshScanSentry offers a free Basic Scan (automated port and vulnerability-script scanning), a paid Deep Scan (full-port network scan plus an active web application scan), optional paid follow-on packages (including a findings report, a guided remediation session, custom managed-remediation engagements, and a Continuous Monitoring subscription), all as described on the Service at the time of purchase. Specific scope, turnaround times, and pricing for each package are as shown on the Service and may change from time to time; changes do not apply retroactively to packages already purchased.

3. No Warranty

Scans are provided on a best-effort, automated basis. No scan, automated or manual, can guarantee the discovery of every vulnerability present in a system. The Service and all results are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. You remain solely responsible for the security of your own systems.

4. Payments, Billing, and Cancellation

One-time packages (including the Deep Scan) are charged once, at the time of purchase, via your chosen payment method (PayPal or card via Stripe), and are generally non-refundable once the associated scan or engagement has begun, except where required by law.

The Continuous Monitoring subscription bills automatically on a recurring monthly basis via Stripe until you cancel. You may cancel at any time, effective at the end of your current billing period, using the "Manage or cancel your Continuous Monitoring subscription" link on the Service — no phone call or written notice is required. Charges already processed for the current billing period are not refunded upon cancellation, except where required by law. Where an annual-pricing plan is offered with an introductory free period, the first billing cycle is free as stated at checkout; the subscription then automatically continues at the regular price unless cancelled before the free period ends.

5. Acceptable Use

You agree not to use the Service to:

We may suspend or terminate your access to the Service, without refund, if we reasonably believe you have violated these Terms.

6. Limitation of Liability

To the fullest extent permitted by law, FreshScanSentry and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

7. Your Data

Scan results are associated only with the session or account that requested them and are not shared with other customers. Contact, quote-request, and feedback submissions are used only to respond to you and to operate and improve the Service. We do not sell your personal information.

8. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continued use of the Service after a change constitutes acceptance of the revised Terms.

9. Governing Law

[Placeholder — specify the state/country whose law governs these Terms, and whether disputes are resolved in court or arbitration, once reviewed with counsel.]
